En tercer lugar, la marca que se está falsificando debe estar registrada federalmente en la Oficina de Patentes y Marcas de los Estados Unidos y debe estar siendo usada actualmente por los titulares de la marca.

En cuarto lugar, los bienes que el falsificador esté fabricando/vendiendo deben ser del tipo que esté cubierto por los registros de marca del titular de una marca; Las marcas comerciales están registradas por “clase de bienes”, recuerde. La ropa y el calzado, por ejemplo, están incluidos en la Clase 25.

Por último, el uso de una marca falsificada es "probable que cause confusión" entre los consumidores en cuanto a si el artículo falsificado es un bien legítimo o que está de alguna manera relacionado con / respaldado por el titular de la marca.

第四類是頂級貨，這類產品與專櫃正品相差無幾，無論是皮質、五金還是做工都屬一流。市場價格通常介於800至2000元之間。以品牌來說，FENDI約在1000元左右，LV略高於1000元，而愛馬仕的鉑金或凱莉款則約需2000元起，當然具體價格還會根據包包的大小和所用皮料有所變動。

第五類為原單品質，採用進口高級牛皮製作，日產量僅數件。製作全程以手工一針一線縫製，工藝精細，質感卓越。由於產量有限且選用頂級材料，價格相對較高。對於熱愛包包的收藏者來說，這類包款非常值得珍藏。

一種是代工廠，目前在大陸有LV、Gucci、Prada、Chanel等品牌的代工廠，這類工廠無論在管理、打版技術及質量檢驗標準方面，均引進了國外的先進體系，因此屬於行業內的優秀企業。

另一類是高仿工廠，其經營環境較為嚴峻，受打擊力度較大，因此逐漸轉入地下運作。相比正品代工廠，高仿工廠的生產和儲存條件較差，眾多不同材料和染劑混合使用，導致氣味交叉嚴重，工廠內缺乏有效的除味和通風設施。因此，普通消費者收到的高仿包多伴隨較重氣味，需經過一段時間方能散去。

儘管中國擁有不少優秀的代工廠，但敢於公開承認代工身份的品牌非常稀少。國際一線品牌中，究竟有多少工廠敢直接表明自己是代工廠呢？根據各品牌代工廠的入駐時間與經驗，我將為大家詳細介紹哪些品牌擁有真正的原單資源，哪些則不具備。

LV是中國頂級高仿中品質最優秀的品牌之一，其質量與專櫃正品難以區分，但並不存在所謂可購買的原單貨。

Prada的代工廠數量較多，基本上獲得原單貨相對較容易，且存在純原單和組裝貨的區別。不過市場上的原單貨較少，高仿產品較多。許多商家會用原單的圖片銷售高仿貨，因為普通消費者難以辨別真偽。

GUCCI ：个别款有原单，大部分没有。
