on 19 sept. 1874 capitalist owners of granite mills in fall river, mass. forced 300 of its employees to report to work, 100 of whom were child laborers (girls) under the "supervison" of older male overseers. at 6:50 a.m. a fire engulfed all six floors of the mill, including the 4th floor where the girls were forced to work. the fire dept failed to arrive in time and was unable to organize a coordinated response to put out the fire (e.g., failing to splice ladders to reach the top floors). by 5:00 p.m., 23 little girls had burned to death. despite the mill owners refusing to fill its tanks, pumps, pipes, and hoses with water, and despite their failure to warn workers on the upper floors about the fire and its decision to save costs and not construct adequate fire escapes, the massachusetts supreme judicial court held that the mill owners could not be liable for the death of the children because state law prohibited corporate liability for harm caused by employers to its employees
