Chapter 2 section 1 of the Bill of Rights affirms the rights of all people in the country and also democratic values of human dignity, equality and freedom. Section 9.3 speaks further on equality expressly stating that, “the state may not unfairly discriminate directly or indirectly against anyone on one or more grounds, including race, gender, sex, pregnancy, marital status, ethnic or social origin, color, sexual orientation, age, disability, religion, conscience, belief, culture, language and birth.

 However, it has to be noted that both the right to be discriminated against one’s sexuality and religious right are both not absolute. We decided to venture into this disjuncture especially focusing on transgender rights. A lot has been said and written on lesbian, gay and intersex rights but little is spoken of the transgender experience hence the decision to stand up for their rights as they are more visible in the societies and vulnerable to abuse and discrimination.
