Counsel is Herb Sanders, and James Noseda (Detroit Corporation Counsel). Defending Mayor Bing are Miller Canfield attorneys Irene Hathaway, Larry Saylor, and Mike McGee. The State of Michigan is represented by Assistant Attorney General Mike Murphy.

Free Detroit No Consent was formed by a non-partisan coalition of politically active Detroiters on the day that the Consent Agreement declaring a Financial Stability Agreement that would change the government of the City of Detroit, bringing the State of Michigan in as a financial partner and custodian was agreed upon by the Mayor and City Council. The date was April 4, 2012, the 45th anniversary of the assassination of Martin Luther King Jr.

The elected representatives of the people have acted without consent of the public, they have acted as governors of the people exercising control rather than representing the people. There was no "super-majority" passage of this Consent Agreement, nor was it placed on a ballot to allow the people to consent.
