"...the term ‘state of exception’ has been used by Italian political theorist Giorgio Agamben to explain the ways in which emergencies, crises and disasters are exploited by the state to justify the suspension of the rule of law in service of a "greater good" (Agamben, 2005). Agamben argues that states of exception are not a special form of law, but rather a ‘suspension of the judicial order itself, [defining] law's threshold or limit concept’ (Preston, Chadderton and Kitagawa, 2014). States of exception serve to bring into being the concepts of sovereignty, the state and its citizens, and modern law - the capacity of the state to not just overwrite, but underwrite the law (Schmitt, 2008). Exceptionalism has the effect of turning fear of the enemy into the constitutive principle of social order, structuring the law and community around it, by redistributing fear and trust, reframing inclusion and exclusion, and necessitating a predisposition towards violence (Huysmans, 2004)."

On 3 December 2018, the Premier of Victoria, the Hon. Daniel Andrews MP, announced that the Victorian Government would establish a Royal Commission to independently inquire into Victoria Police’s recruitment and management of a class of informants. The announcement followed decisions of the High Court of Australia, the Victorian Court of Appeal and the Supreme Court of Victoria, regarding a former criminal defence barrister recruited by Victoria Police as an informant.

As part of its inquiry, the Royal Commission will examine the number of, and extent to which, cases may have been affected by the conduct of Ms Nicola Gobbo, a criminal defence barrister who was, at various times between 1 January 1995 and 13 January 2009, acting as a police informant with Victoria Police.  She was referred to as 'EF' in recent court cases, informant '3838' and other informant numbers by Victoria Police, and was often referred to as 'Lawyer X' in the media.
