Since 1 April 2013 all NHS foundation trusts need a licence from Monitor stipulating specific conditions that they must meet to operate. Key among these are financial sustainability and governance requirements.

The 'Risk assessment framework' describes our approach to overseeing the sector under the new rules. It explains how we will use the framework to assess individual NHS foundation trusts’ compliance with two specific aspects of their work: the continuity of services and governance conditions in their provider licences.

From 1 October 2013, the 'Risk assessment framework' will replace our 'Compliance Framework'.

Monitor: Hello, Jason. This report looks at foundation trusts’ operational, financial and regulatory performance. What would you say are the most important trends the report highlights?

Jason Dorsett: NHS foundation trusts are performing well in providing quality services to patients in challenging economic times.

Trusts have so far managed to cope with winter pressures on A&E departments, but there has been a noticeable deterioration in performance on waiting times, particularly for some cancer targets.

We are concerned about how this might impact on future performance and are continuing to monitor the situation closely.

Monitor: What financial trends does the report highlight?

Jason Dorsett: The foundation trust sector as a whole remains in surplus, but the size of the surplus has halved since this time last year. This is a reflection of the challenging economic climate.

Thirty nine trusts were in deficit in this quarter which is 15 more than was expected, although most of these are already subject to regulatory action through which Monitor is helping them overcome their problems.

Overall the sector has struggled to deliver the required efficiency savings having £867m so far this year which is 18% (£185m) behind what they planned at this stage.

Monitor: Hi, Jason. This report looks at foundation trusts’ operational, financial and regulatory performance between April 2013 and March 2014. What would you say are the most important trends the report highlights?

•	NHS foundation trusts have had mixed experiences in meeting the dual challenge of providing quality care to patients and maintaining good finances during  the year;
• Overall, trusts met national performance standards for the majority of operational targets tracked by Monitor over the course of 2013/14

• Trusts hired an additional 24,000 members of staff last year, three times what was planned, in order to upgrade the quality of services to patients

• However, in a sign of the increased pressures upon services, more trusts failed to meet waiting times targets in the final quarter (January to March 2014)

Monitor: What financial trends does the report highlight?

• The NHS foundation trust sector ended the year in surplus, however, the surplus was one-third the size of the previous year, reflecting the increased investment in staffing, and the ongoing challenging economic climate

• 40 trusts ended the year in deficit, which is more than planned (16), and almost double the number last year (21)

• The combined deficit of the 40 trust (£307m) was higher than expected (£190m), although 22 organisations already subject to regulatory action or investigation by Monitor account for 70% of the overall deficit
