Um homem preso em flagrante ao transportar cerca de 870 kg de maconha entre os estados de São Paulo e Paraná teve pedido de liberdade negado pela Sexta Turma do Superior Tribunal de Justiça (STJ). 
A prisão em flagrante – convertida em preventiva – foi efetuada por agentes rodoviários no Paraná. Ao realizarem a vistoria no caminhão do suspeito, os policiais localizaram um fundo falso, no qual estava guardada a droga.
O réu foi condenado a 14 anos e sete meses de prisão, em regime fechado, pelo crime de tráfico de entorpecentes. 
No pedido de habeas corpus dirigido ao STJ, a defesa sustentou a ausência de fundamentos concretos e dos requisitos legais para a prisão cautelar.
Para a relatora, ministra Laurita Vaz, a quantidade de droga apreendida mostra o perigo que o agente representa e confirma a necessidade da prisão como forma de garantir a ordem pública. A ministra ainda observou que o Tribunal de Justiça de São Paulo (TJSP) negou o primeiro habeas corpus com base nos indícios concretos de autoria e de materialidade do crime – circunstâncias que, para ela, confirmam a periculosidade do réu.
