Deze podcast gaat over het advies van de Afdeling advisering van de Raad van State, gepubliceerd op 22 september 2025, over een wetsvoorstel tot wijziging van de Huisvestingswet 2014.

Het wetsvoorstel beoogt een gefaseerd verbod in te voeren op het verlenen van voorrang aan vergunninghouders, ook wel statushouders genoemd, voor sociale huurwoningen.

De Afdeling advisering concludeert dat het wetsvoorstel in strijd is met het grondwettelijk gewaarborgde recht op gelijke behandeling, aangezien de voorgestelde maatregelen van de regering waarschijnlijk niet tijdig een gelijke uitgangspositie voor deze groep zullen creëren. Bovendien belemmert het voorstel gemeenten in hun beleidsvrijheid en maakt het de uitvoering van hun wettelijke taakstelling om vergunninghouders te huisvesten zeer moeilijk.

De Raad van State adviseert de regering daarom negatief over het wetsvoorstel en raadt aan het niet in te dienen bij de Tweede Kamer.

Woonminister Mona Keijzer (BBB) stuurt de wet om voorrang voor statushouders bij sociale huurwoningen te verbieden zo snel mogelijk naar de Tweede Kamer. Dat zegt ze in een reactie nadat de Raad van State haar maandag juist had geadviseerd de wet niet in te dienen.
