O presidente do Superior Tribunal de Justiça (STJ), ministro Humberto Martins, decidiu que o Tribunal não vai julgar um mandado de segurança impetrado pela Ordem dos Advogados do Brasil (OAB) e por várias entidades artísticas contra atos da Secretaria Especial de Cultura do Ministério do Turismo. 
A OAB e as entidades apontaram que por orientação política do ministro do Turismo, a Secretaria Nacional de Fomento e Incentivo à Cultura deixou de publicar 450 portarias de homologação para captação de recursos referentes a projetos que seriam enquadrados na Lei Rouanet. De acordo com as entidades, se os atos não forem publicados até o dia 24 de dezembro, diversos projetos culturais serão inviabilizados. 
Segundo o presidente do tribunal, na hipótese de o ato atacado não ter sido praticado por ministro de Estado, não compete ao STJ julgar a demanda. Ao indeferir liminarmente a petição, Humberto Martins explicou que tais atos são de competência direta do secretário nacional de Fomento e Incentivo à Cultura, órgão subordinado à Secretaria Especial de Cultura do Ministério do Turismo.  
Para fundamentar essa decisão, o ministro citou entendimento da Primeira Seção do STJ contra esse tipo de impetração, segundo a qual o Tribunal não pode julgar mandado de segurança contra ministros de Estado por atos de subordinados, já que tal lógica permitiria, por exemplo, sucessivas impetrações diretas junto ao Supremo Tribunal Federal (STF) por atos de subordinados do presidente da República.
