A collection of texts that provide the foundation for the University of Chicago’s longstanding tradition of free expression, principles that are at the center of current debates within higher education and society more broadly.
 
Free inquiry and expression are hotly contested, both on campus and in social and political life. Since its founding in the late nineteenth century, the University of Chicago has been at the forefront of conversations around free speech and academic freedom in higher education. The University’s approach to free expression grew from a sterling reputation as a research university as well as a commitment to American pragmatism and democratic progress, all of which depended on what its first president referred to as the “complete freedom of speech on all subjects.” In 2015, more than 100 years later, then University provost and president J. D. Isaacs and Robert Zimmer echoed this commitment, releasing a statement by a faculty committee led by law professor Geoffrey R. Stone that has come to be known as the Chicago Principles, now adopted or endorsed by one hundred US colleges and universities. These principles are just a part of the long-standing dialogue at the University of Chicago around freedom of expression—its meaning and limits. The Chicago Canon on Free Inquiry and Expression brings together exemplary documents – some published for the first time here – that explain and situate this ongoing conversation with an introductory essay that brings the tradition to light.
 
Throughout waves of historical and societal challenges, this first principle of free expression has required rearticulation and new interpretations. The documents gathered here include, among others, William Rainey Harper’s “Freedom of Speech” (1900), the Kalven Committee’s report on the University’s role in political and social action (1967), and Geoffrey R. Stone’s “Free Speech on Campus: A Challenge of Our Times” (2016). Together, the writings of the canon reveal how the Chicago tradition is neither static nor stagnant, but a vibrant experiment; a lively struggle to understand, practice, and advance free inquiry and expression.
 
At a time of nationwide campus speech debates, engaging with these texts and the questions they raise is essential to sustaining an environment of broad intellectual and ideological diversity. Higher education is a familiar battlefield in today’s culture wars. The right accuses colleges and universities of indoctrinating conservative students with liberal values; the left, with failing to be sufficiently inclusive. The anxieties expressed on both sides of the political spectrum have much in common, however, and they are triggered not by colleges’ failures but by their successes.

While the networks that colleges build for students have great value, learning to inhabit them pulls some students away from their families and communities. Interrogates the connections between a city’s physical landscape and the poverty and social problems that are often concentrated at its literal lowest points.

In Urban Lowlands, Steven T. Moga looks closely at the Harlem Flats in New York City, Black Bottom in Nashville, Swede Hollow in Saint Paul, and the Flats in Los Angeles, to interrogate the connections between a city’s actual landscape and the poverty and social problems that are often concentrated at its literal lowest points. Taking an interdisciplinary perspective on the history of US urban development from the nineteenth to the mid-twentieth century, Moga reveals patterns of inequitable land use, economic dispossession, and social discrimination against immigrants and minorities. In attending to the landscapes of neighborhoods typically considered slums, Moga shows how physical and policy-driven containment has shaped the lives of the urban poor, while wealth and access to resources have been historically concentrated in elevated areas—truly “the heights.” Moga’s innovative framework expands our understanding of how planning and economic segregation alike have molded the American city.

Urban Lowlands: A History of Neighborhoods, Poverty, and Planning (Sample)

In addition to his groundbreaking contributions to pure economic theory, F. A. Hayek also closely examined the ways in which the knowledge of many individual market participants could culminate in an overall order of economic activity. His attempts to come to terms with the “knowledge problem” thread through his career and comprise the writings collected in the fifteenth volume of the University of Chicago Press’s Collected Works of F. A. Hayek series.

The Market and Other Orders brings together more than twenty works spanning almost forty years that consider this question. What Eric Voegelin attempts in The New Science of Politics is nothing less ambitious than a complete theory of humanity, society, and history. To build his theory, Voegelin draws on a breathtaking range of subjects from throughout history, including the Mongol Orders of Submission, the Behistun Inscription, and a controversy over an alter to the goddess Victoria in the Roman Forum. Addressing the access to truth afforded by myth, revelation, and philosophy, Voegelin then carefully contrasts each with gnosticism. The New Science of Politics: An Introduction (Sample)

For more than fifty years, Robert G. McCloskey’s classic work on the Supreme Court’s role in constructing the US Constitution has introduced generations of students to the workings of our nation’s highest court.

As in prior editions, McCloskey’s original text remains unchanged. In his historical interpretation, he argues that the strength of the Court has always been its sensitivity to the changing political scene, as well as its reluctance to stray too far from the main currents of public sentiment. Although the colonial wars consisted of almost continuous raids and skirmishes between the English and French colonists and their Indian allies and enemies, they can be separated into four major conflicts, corresponding to four European wars of which they were, in varying degrees, a part: King William’s War (1689-97) (War of the League of Augsburg); Queen Anne’s War (1702-13) (War of the Spanish Succession); King George’s War (1744-48) (War of the Austrian Succession); and The French and Indian War (1755-62) (Seven Years’ War).

The Perils of Prosperity, 1914-1932, Second Edition (Sample)

American Judaism, Second Edition, Revised (Sample)

Few scenes capture the American experience so eloquently as that of a lonely train chugging across the vastness of the Great Plains, or snaking through tortuous high mountain passes. Although this vision was eclipsed for a time by the rise of air travel and trucking, railroads have enjoyed a rebirth in recent years as profitable freight carriers.

A fascinating account of the rise, decline, and rebirth of railroads in the United States, John F. Stover’s American Railroads traces their history from the first lines that helped eastern seaports capture western markets to today’s newly revitalized industry. Stover describes the growth of the railroads’ monopoly, with the consequent need for state and federal regulations; relates the vital part played by the railroads during the Civil War and the two World Wars; and charts the railroads’ decline due to the advent of air travel and trucking during the 1950s.

In two new chapters, Stover recounts the remarkable recovery of the railroads, along with other pivotal events of the industry’s recent history. During the 1960s declining passenger traffic and excessive federal regulation led to the federally-financed creation of Amtrak to revive passenger service and Conrail to provide freight service on bankrupt northeastern railroads. The real savior for the railroads, though, proved to be the Staggers Rail Act of 1980, which brought prosperity to rail freight carriers by substantially deregulating the industry. By 1995, renewed railroad freight traffic had reached nearly twice its former peak in 1944.

Bringing both a seasoned eye and new insights to bear on one of the most American of industries, Stover has produced the definitive history of railroads in the United States.

American Railroads, Second Edition (Sample)

When Andrea Louise Campbell’s sister-in-law, Marcella Wagner, was run off the freeway by a hit-and-run driver, she was seven-and-a-half months pregnant. She survived—and, miraculously, the baby was born healthy. But that’s where the good news ends. Marcella was left paralyzed from the chest down. This accident was much more than just a physical and emotional tragedy. Like so many Americans—50 million, or one-sixth of the country’s population—neither Marcella nor her husband, Dave, who works for a small business, had health insurance. On the day of the accident, she was on her way to class for the nursing program through which she hoped to secure one of the few remaining jobs in the area with the promise of employer-provided insurance. Instead, the accident plunged the young family into the tangled web of means-tested social assistance.
          
As a social policy scholar, Campbell thought she knew a lot about means-tested assistance programs. What she quickly learned was that missing from most government manuals and scholarly analyses was an understanding of how these programs actually affect the lives of the people who depend on them. Using Marcella and Dave’s situation as a case in point, she reveals their many shortcomings in Trapped in America’s Safety Net. Because American safety net programs are designed for the poor, Marcella and Dave first had to spend down their assets and drop their income to near-poverty level before qualifying for help. What’s more, to remain eligible, they will have to stay under these strictures for the rest of their lives, meaning they are barred from doing many of the things middle-class families are encouraged to do: Save for retirement. Develop an emergency fund. Take advantage of tax-free college savings. And, while Marcella and Dave’s story is tragic, the financial precariousness they endured even before the accident is all too common in America, where the prevalence of low-income work and unequal access to education have generated vast—and growing—economic inequality. The implementation of Obamacare has cut the number of uninsured and underinsured and reduced some of the disparities in coverage, but it continues to leave too many people open to tremendous risk.

Behind the statistics and beyond the ideological battles are human beings whose lives are stunted by policies that purport to help them. In showing how and why this happens, Trapped in America’s Safety Net offers a way to change it.
