287. Pentagon UFO Report Incoming, Rising Gas Prices

Heartland Institute President James Taylor explains why we must all must fight to protect free speech on the internet. State legislators, too, have a role in protecting the right of their constituents to speak freely on line. As he said in a recent live Heartland Webinar, Section 230 of the federal Communications Decency Act does not address or preclude state action to protect political free speech on the Internet.
"Section 230 does not give the tech giants, the tech cartel, the right to censor political free speech. Again, this Section 230 explicitly says the purpose is to maximize user control -- not Facebook control, not Google control, not platform control," Taylor said.

"[Online speech] must be sexually obscene or excessively violent, otherwise you do not have blanket authority to play God in terms of what you do or don't allow on the Internet. Yes, we do have the right to insist that we can speak freely, especially on political topics and cultural topics, on the Internet," he said.

329: Energy Crisis in Europe, What Can We Expect in the U.S.?

Armed with information provided by The Heartland Institute, a number of states are passing bills and regulations which pull the states' business, bond writing, pension management, etc…,  from banks, fund management firms, and pension funds whose managers are placing support for progressive ESG and social credit score goals ahead of making a profit and a return on investment.

The states laws are intended to prevent woke company managers from forcing the companies and individuals they do business with to divest from companies in politically disfavored industries, primarily but not solely, fossil fuels. ESG investing is bad for financial returns, bad for taxpayers, and ultimately bad for the U.S. economy.

The Supreme Court ruling in the United States' case of Sackett v. EPA has emerged as a pivotal decision, significantly impacting individual liberty, the constitutional balance of power, and the containment of the regulatory state for the first time in decades. The verdict mandates that wetlands must be categorically "wet" and directly connected to navigable waters. As a result, landowners, developers, farmers, and other property holders now have clearer guidelines about whether they need to seek approval from the U.S. Environmental Protection Agency before using their properties for routine purposes.

Milton Friedman was a staunch advocate for privatizing Medicaid and Social Security, relying on the free market to regulate healthcare. The 'Plan for America' (PFA) is a proposal to bring this vision to life. Terry Nager, one of the co-authors of this plan, aimed to fortify the nation's entitlement programs, alleviate the country's deficits, debts, and unfunded liabilities, and provide Americans with personal accounts that they could grow using compound interest. These accounts would grant individuals the freedom and resources to purchase private lifetime health insurance.

Nager provides an in-depth discussion on how the PFA would operate, the origins of the plan, why attempts to privatize entitlement programs failed under President George W. Bush, why the plan would appeal to younger generations, and how it could guarantee the same benefits currently associated with Social Security and Medicare. He also addresses the prospect of most people accruing sufficient funds in their accounts to bequeath a financial legacy to their families.

Milton Friedman's Vision: A ‘Plan for America’ and the Future of Entitlements

In early spring of 2021, the family of Grace Schara, a 19-year-old young woman with Down’s Syndrome, brought their daughter to an emergency room at the direction of an urgent care clinic due to wavering blood oxygen levels from COVID-19. According to her father Scott Schara, this was a grave mistake.
 
Schara claims the hospital, St. Elizabeth’s in Appleton, Wisconsin, became an adversary, not an ally, in treating Grace.  The relationship broke down when the Schara's were not convinced Grace needed to be put on a ventilator, a treatment encouraged by the federal government with financial incentives. Within a matter of days, Grace was dead. Her family discovered the physician put a Do Not Resuscitate (DNR) order in place and infused a combination of powerful anesthesia drugs into her system. As a result, they've filed a lawsuit claiming the hospital engaged in euthanasia. 
 
Schara insists that this lawsuit extends beyond mere malpractice. He says his family initiated the legal battle to highlight concerning issues related to hospital care, COVID-19 treatment policies, financial incentives, DNR orders, and the rights of the disabled. Supporting his argument, Scott shared three documents: Section 1553 of the Affordable Care Act (Public Law 111-148, March 28, 2010), which tackles the "prohibition against discrimination on Assisted Suicide," a letter from Jennifer Garrett of the Wisconsin Department of Safety and Professional Services which refers to Chapter 154 of WS Statutes indicating there was no action against the physician who implemented the DNR order against Grace, and policy guidance from the Palliative Care Network of Wisconsin outlining how medical professionals should treat individuals with Down Syndrome. Is it possible that Obamacare was intentionally set up to falter, leading frustrated Americans to implore the federal government to assume control of health care? Devon Herrick posits this theory, having recently explored the topic on the Goodman Health Blog. He highlights that without the crutch of subsidies, Obamacare is destined to collapse — a prediction echoed by many during the 2009-2010 debates surrounding the inception of the Affordable Care Act.

Herrick delves into various topics, including the expansion of Medicaid, and the concept of Medicare for All — or as he terms it, “Medicaid for All.” Since the enactment of the ACA, 21 states have contemplated bills advocating for single-payer systems. However, the majority of these proposals were thwarted due to their exorbitant costs. For instance, Vermont terminated its program, while California’s initiative never came to fruition. Colorado’s electorate decisively rejected a similar proposition. Currently, Michigan is weighing the adoption of a single-payer system, prompting Herrick to pose crucial questions that demand consideration. These include whether employers will participate, if employees will face surcharges for the state plan, and if the state will request the federal government to allocate all Medicaid and Medicare funds directly to the state’s program.

Moreover, the “Medicare for All” concept continues to persist, with a bill garnering the support of 100 legislators introduced this past May. Herrick and Schieber engage in a discussion about the public’s susceptibility to the allure of government-managed health care as opposed to a free-market approach. They ponder why the public readily embraces the free market in sectors like retail and technology — which have witnessed significant innovation and competitive pricing — yet hesitates to do the same for health care.

Everyone wants the latest and greatest drug treatment at a reasonable price. The best way to do this is with a robust generic drug industry.  The generic drug industry allows brand name drug makers to focus on drug development by offering an affordable option later in a drug’s life cycle.  Chip Davis, president and CEO of the Association of Accessible Medicines (AAM), discusses how generics are saving consumers millions of dollars. He explains why there can be price volatility with generics, how shortages in generics can affect prices and why those shortages occur.

Davis explains the danger in setting price controls on generics. Through the supply chain, prescription benefit managers can impact generic drug prices and generics role in the opioid epidemic. Davis explains why reducing supply may not be the solution to addressing the epidemic.  According to AAM, generics represent 90 percent of all US prescriptions dispensed, but only 23% of what the US spends on medicine. Davis also provides an update on the lawsuit the industry filed against the state of Maryland when it attempted to control generic drug prices.

Most employers purchase health insurance through insurance brokers. For their service, brokers earn a commission on premiums.  So why would they want to shop for the most affordable plans?  Employers usually cover 70 percent of premiums and can save money on their end by cutting benefits and increasing co-pays and deductibles.  The difference is made up by the employee.  Wages have risen little to compensate for this extra cost.  Carpel discusses why health insurance brokers should act more like fiduciaries.  Until then, there are options, including self-funded plans with reinsurance and ways to get around the insurance/provider PPO cartel.

Steve McIntyre, founder and editor of the blog dedicated to analysis of climate data Climate Audit, discusses how he first became interested in climate discussion. He and friend Dr. Ross McKitrick helped debunk one of the most important climate papers: 'The Hockey Stick.' Though only a businessman with a little formal knowledge of the debate, he was worried that climate alarmists were attempting to engage a war on fossil fuels. McIntyre reached out to Michael Mann only to be informed that he did not have the data on hand. In fact, when asking another researcher, he was told nobody had ever asked for data in 28 years.

He goes to show that if there truly is a consensus on the issue, there would be no need to hide and obfuscate data.

Debunking the Hockey Stick, Part Two (Guest: Steve McIntyre)

In 2017, over 420 New Hampshire residents died due to an opioid overdose. Further, the epidemic has cost the New Hampshire economy $6.6 billion between 1999 and 2015.

To address the issue, New Hampshire State Representative has introduced House Bill 1563 which would reform the state’s criminal asset forfeiture laws. Under the proposed bill, proceeds that are seized after a criminal conviction would be dispersed to a Governor’s council to use to fund medication, rehabilitation and other programs to address the opioid epidemic.

Yet, for nearly 20 years, the deep state bureaucrats at the behest of radical environmentalists have blocked its development due to unfounded fears it would harm the salmon fishery in Bristol Bay, 200 miles downriver.  The environmental impact statement shows the mine can be developed with little negative environmental impact and no impact on the salmon. Thus, preventing the mine from being developed is unjustified as a matter of law, and poor as a matter of economic policy.
