This practice mirrors the accommodation long afforded to baptized Sikhs for the carrying of the kirpan, an article of faith that resembles a dagger and must be made of metal. In Multani v. Commission scolaire Marguerite-Bourgeoys, 2006 SCC 6, the Supreme Court of Canada recognized the kirpan as a sincerely held religious object and held that prohibitions on its carrying infringe freedom of religion under s. 2(a) of the Canadian Charter of Rights and Freedoms unless justified by a pressing objective and proportionate means. The Court emphasized that absolute bans are unreasonable where reasonable accommodations (such as secure sheathing) can address safety concerns without trivializing the religious practice.I request similar recognition: permission to carry my sheathed Ceremonial K-Bar during ordinary daily activities, subject to reasonable conditions (e.g., fixed sheath, worn under clothing, or other measures to ensure it remains secure and non-threatening).This accommodation would allow full practice of my creed in public life, consistent with Canada's commitment to religious freedom and multiculturalism.
The guarantee of equal treatment under the law according to the Code demands that my faith be treated the same as the Sikh faith, and denying this request would be a violation of my Charter equality rights, applying a different standard to my religion than is applied to the Sikhs.This position is supported by s. 15(1) of the Canadian Charter of Rights and Freedoms, which guarantees equality before and under the law and equal protection and benefit of the law without discrimination based on religion.
