L’absurdité du 1er mai dans certains secteurs professionnels, comme les boulangeries ou les fleuristes, où **les salariés n’ont pas le droit de travailler** — même avec leur plein consentement — et où **les employeurs risquent une amende de 750 €**, soulève un **véritable problème de cohérence et de logique législative**.

À l’origine, le 1er mai est la **Fête du travail**, un jour de **commémoration des luttes ouvrières** et, dans de nombreux pays, un **jour chômé**. En France, ce jour bénéficie d’un statut particulier : c’est le **seul jour férié obligatoirement chômé et payé**. Cette protection historique, héritée des combats sociaux, est respectable. Mais lorsqu’elle se transforme en **interdiction pure et simple de travailler**, même sur la base du volontariat ou dans des secteurs très spécifiques, **on sort du cadre de la protection pour entrer dans l’absurde.**

Prenons le cas d’un salarié de boulangerie, volontaire pour venir travailler le 1er mai, parce qu’il sait que ce jour-là, **la demande est forte**, que les clients sont nombreux à vouloir une baguette, un croissant ou un gâteau pour leur déjeuner familial. Ce salarié peut être **motivé, correctement payé**, voire mieux rémunéré que les autres jours. Et pourtant, la loi interdit qu’il exerce. Son employeur, même s’il respecte le volontariat et la législation sociale, **s’expose à une amende de 750 €**, infligée par un **contrôleur du travail… qui, lui, travaille ce jour-là**.

Cette situation est **éminemment paradoxale** : le seul qui puisse exercer une activité rémunérée sans restriction ce jour-là… est celui qui **vient empêcher les autres de le faire**. On atteint là un **niveau d’incohérence bureaucratique qui défie la logique économique, sociale et humaine.**

Certes, il est essentiel de **protéger les droits des travailleurs**, d’empêcher les abus, de garantir qu’un jour symbolique ne devienne pas une journée de pression ou d’exploitation. Mais dans ces métiers où **l’activité est souvent saisonnière**, où **les marges sont faibles**, et où **les salariés eux-mêmes réclament parfois le droit de travailler**, pourquoi imposer une interdiction aussi rigide ?

D’autant plus que dans la pratique, ce type de loi **ne protège personne**. Il pénalise des patrons souvent artisans, des commerçants de proximité, des salariés investis. Il fait perdre du chiffre d’affaires, **crée du ressentiment**, et surtout, **fragilise la relation entre les travailleurs et les institutions** censées les défendre.

Pire encore : cette absurdité alimente **le sentiment d’un État déconnecté**, qui pond des règles sans tenir compte des réalités du terrain. Cela nourrit la **frustration**, la **défiance**, voire le **détournement volontaire de la loi**.

Et si, au lieu d'interdire, on **autorisait mais encadrait** ? Si on laissait ceux qui le souhaitent **travailler librement**, en échange de garanties : majoration salariale, accord écrit, repos compensateur ? Ce serait plus juste, plus réaliste, et surtout plus respectueux des **choix individuels**.

Car au fond, ce que cette absurdité illustre, c’est une **méfiance de l’État envers ses citoyens**, une forme de **paternalisme autoritaire** déguisé en protection. Il est peut-être temps de **repenser certaines règles**, non pas pour les abolir, mais pour **les adapter à la réalité**.

On peut défendre la dignité du travail sans en faire une prison. On peut honorer la mémoire des luttes sociales **sans interdire à ceux qui aiment leur métier d’en vivre, même un jour férié.** Et surtout, **on peut légiférer avec bon sens.**

Car à force d’écrire des lois à contretemps, on finit, comme le dit la chanson… **par pondre des lois à la con.**

Meaning:
I wrote Say It To My Face about a toxic relationship. At the time, it was obvious my ex and I were not in a good place. Whenever I would try and talk to her about our issues, she would say that everything was fine and did not want to discuss it. It came out later that she was afraid she would lose me if she spoke her truth. Meanwhile, I was unable to do anything about our issues without knowing how she really felt. It created this crazy situation where we could never get on the same page and we kept upsetting each other over and over. Say It To My Face came out of the frustration of never knowing what she really wanted.
