E180 | How have the immense transformations of the nineteenth century impacted Egyptian state and society? Our guest Dr. Khaled Fahmy has devoted much of his work to the study of that very question in the realms of military, medicine, and in this episode, law, which is the subject of his forthcoming book. In this episode, we explore the emergence to of new legal institutions under Mehmed Ali's government in Egypt and ask Dr. Fahmy what this meant for Egypt and how it fits into the broader changes afoot in the Ottoman world. 

Khaled Fahmy is Professor of History at the American University of Cairo and 2014-2015 Carnegie Centennial Fellow at Columbia University. He is the author of All the Pasha's Men: Mehmed Ali, His Army, and the Making of Modern Egypt (AUC Press, 2010). His new book, tentatively entitled  A Sense of History: Law and Medicine in Modern Egypt, is forthcoming from the University of California Press.

Susanna Ferguson is a PhD student in Middle Eastern History at Columbia University, where she focuses on the history of women and gender in the Arab world in the late 19th and early 20th centuries.

Law and Order in Late Ottoman Egypt | Khaled Fahmy

E212 | Much of the scholarship on the Hanafi school of Islamic jurisprudence, which had its roots in the sociopolitical context of the 8th century Iraq, focuses on the early centuries of that school's development. Meanwhile, recent scholarship on the later periods emphasizes the transformations within the Hanafi jurisprudence in the early modern and modern periods, particularly as a result of the increasing role of the Ottoman state in the process of lawmaking. Dr. Samy Ayoub presents a different approach on Ottoman Hanafi jurists, who maintained the integrity of the legal discourse while recognizing the needs of the times. In this episode, Dr. Ayoub shares some of his reseach on the question of continuity and change under the self-desctibed “late-Hanafis” from the 16th century until the making of mecelle, the first attempt at codifying Islamic law, during the late 19th century.

Samy Ayoub earned his Ph.D. in Islamic law from the School of Middle Eastern and North African Studies and the James E. Rogers College of Law at the University of Arizona. He earned a B.A. in Islamic jurisprudence from Al-Azhar University in Cairo, Egypt, in 2006, where he received systematic instruction in Ḥanafī jurisprudence. He also received an MSc. in Middle Eastern and Islamic Studies from the University of Edinburgh in Scotland, UK, in 2008. Dr. Ayoub’s research interests cover the history of the early modern Ottoman Empire, contemporary Arab legal regimes, Muslim ethics, and the Arab renaissance (nahḍa).

Late Hanafi Law in the Ottoman Empire | Samy Ayoub

E275 | The turn of the nineteenth century was a period of tumult and transformation in the Ottoman Empire, as in many places around the world from France to Haiti, China, and the United States. With people, ideas, and armies on the move as never before, new geopolitical pressures pushed states around the globe to reinvent their relationships to their subjects and citizens. In this episode, we talk with Ali Yaycioglu about his new book Partners of the Empire: The Crisis of the Ottoman Order in the Age of Revolutions. We explore the Ottoman experience during the Age of Revolutions, which saw the rise of new participatory mechanisms that brought Ottoman subjects from many walks of life into the arena of imperial politics. We discuss the empowerment of local committees and the election of ayans in the countryside, and consider the Janissaries as the voice of the popular will in Ottoman cities. Ultimately, we ask why new forms of participatory politics and limits on central authority failed to take root, even as they laid the foundation for later experiments in constitutional government during the Tanzimat era and beyond.

Ali Yaycioglu is Assistant Professor of History at Stanford University. His main focus is on the transformation of the Ottoman Empire in the 18th and 19th centuries, forms of acquiring and losing wealth and power, and spatiality and spatial imaginations in the Ottoman world.

Zoe Griffith is a doctoral candidate in History at Brown University working on political economy and governance in Egypt and the Ottoman Mediterranean. Zoe is a co-curator of the OHP series on legal history in the Ottoman Empire and Islamic world.

The Ottoman Empire in the Age of Revolutions | Ali Yaycioglu

E389 | In the wake of the First World War, the League of Nations oversaw internationally-recognized projects of separation and transfer as the new borders of the Middle East were drawn under the influence of British and French imperial rule. In this episode, we speak to Laura Robson about her research for the book States of Separation, which studied how imperial rule under the mandate system in Iraq, Palestine, and Syria shaped communal definition and relations. In our conversation, we focus on the ways in which the states of the period sought to manage and move minority populations through a scheme to resettle Iraq's Assyrians in South America and other policies of the mandate period.

Laura Robson is a professor of history at Portland State University in Portland, Oregon, currently focusing on histories of forced migration, the construction of refugee and asylum policies, and mass violence in the colonial and postcolonial Middle East. Her most recent books are States of Separation: Transfer, Partition, and the Making of the Middle East (University of California, 2017) and the forthcoming edited volume Partitions: A Transnational History of 20th Century Territorial Separatism (with Arie Dubnov; Stanford, 2019).

Chris Gratien is Assistant Professor of History at University of Virginia, where he teaches classes on global environmental history and the Middle East. He is currently preparing a monograph about the environmental history of the Cilicia region of the former Ottoman Empire from the 1850s until the 1950s.

Transfer and Partition in the Middle East | Laura Robson

E403 |Many students of Middle Eastern history know that that some non-Muslims subjects of the Ottoman Empire became "proteges" of European states in the nineteenth century and thus acquired extraterritorial legal protections. While we know the institutional history of extraterritoriality, the individual motivations and histories of those who chose to become proteges is relatively unknown. In this podcast, Sarah Stein speaks about what extraterritoriality meant to those Jews of the former Ottoman Empire that chose to take this path. In particular, it exposes the tenuous meaning of citizenship in the quickly changing legal world of the early twentieth century, as empires collapsed and new regime of borders and national belonging emerged. Sarah Abrevaya Stein is Professor of History, Maurice Amado Chair in Sephardic Studies at UCLA, and Sady and Ludwig Kahn Director of UCLA’s Alan D. Leve Center for Jewish Studies.  A former Guggenheim Fellow, her award-winning books include Extraterritorial Dreams:  European Citizenship, Sephardi Jews, and the Ottoman Twentieth Century (University of Chicago Press, 2016), Saharan Jews and the Fate of French Algeria (University of Chicago Press, 2014), and Plumes:  Ostrich Feathers, Jews, and a Lost World of Global Commerce (Yale University Press, 2008).  She is also co-editor of four books, including The Holocaust and North Africa, edited by Aomar Boum and Sarah Abrevaya Stein (Stanford University Press, 2018) and Sephardi Lives:  a documentary history, 1700-1950, edited by Julia Phillips Cohen and Sarah Abrevaya Stein (Stanford University Press, 2014).  She is now completing a history that traces the story of a single Sephardic family across the globe and the arc of the twentieth century for Farrar, Straus, and Giroux, Macmillan Publishers.

Nir Shafir researches the intellectual and religious history of the Middle East, from roughly 1400-1800, focusing on material culture and the history of science and technology. He serves an assistant professor of history at UCSD and is part of the editorial board of Ottoman History Podcast as well curating it series on history of science.
