The Suns since 2011 have aired their regular-season games on the Diamond-owned and Bally's-branded regional sports network, which was previously under the Fox Sports banner. Diamond filed for bankruptcy protection in March.


Diamond quickly shot back at the Suns, Gray Television and Kiswe in court papers, calling on the bankruptcy judge to uphold the automatic stay placed over all of Diamond's contracts once it was under chapter 11 protection. Diamond has argued the Suns didn't honor the so-called backend rights of its contract, which gave Diamond the right of first refusal and allowed for an appraisal process to see which media rights deal held the better valuation.


On Wednesday, Judge Christopher Lopez ruled the Suns violated a section of the bankruptcy code and must comply with the terms of their current agreement with Diamond. He added the Suns and Diamond must come to a consensual agreement and find an appraiser to move the process forward.


While there are civil and criminal remedies for creditors to pursue against phoenix companies, unsecured creditors of the bankrupt business are most likely to suffer. Creditors are most likely to spot potential phoenix activity early, but they may not take action after operators of the business pay outstanding bills in an effort to keep supply lines open.


The good news about phoenix companies is that they can generally be spotted and their damage contained. Additionally, more stringent government regulations and heightened financial scrutiny of companies and the people who run them is making it harder for them to get off the ground in the first place.


A U.S. bankruptcy judge on Wednesday blocked the NBA's Phoenix Suns from moving ahead with a television and streaming rights deal for its basketball games, saying the team violated the rights of its current broadcast partner, the bankrupt Diamond Sports Group.


U.S. Bankruptcy Judge Christopher Lopez, however, ruled that the company could not yet move on from its existing contract with Diamond Sports Group, a bankrupt subsidiary of Sinclair Broadcast Group that broadcasts games through its Bally Sports TV channels.


U.S. bankruptcy law protects debtors from having their contracts modified or terminated without their consent, and Lopez ruled that the Suns' new TV deal was void because it interfered with the Diamond Sports' contractual right to negotiate contract extension.





A judge has denied an Arizona real-estate investor's bid to discharge his debts through Chapter 7 bankruptcy, allowing more than 100 creditors with almost $141 million in claims against him to keep trying to get paid.


Alexander Papakyriakou, also known as Alex Papas, and his wife, Roxanne, tried to defraud their creditors by hiding millions of dollars in assets, according to the judge's ruling in the long-running bankruptcy case. According to creditors, those assets included homes in Paradise Valley and Laguna Beach, Calif., luxury cars, life-insurance policies and expensive jewelry.


"This is certainly an atypical bankruptcy. About 90 percent of bankruptcies are approved," said Terry Dake, a Phoenix attorney working with the Bankruptcy Court-appointed trustee for the case. "Papas has a certain skill in structuring assets and transactions to cover up who owns what. Now, we will continue to fight our way through that and find other assets transferred after his bankruptcy filing."


Papas' efforts to relocate assets that he and his wife used before filing for bankruptcy are detailed by plaintiffs and creditors in case filings. Moody Whinery cited several of the examples as reasons not to approve the bankruptcy discharge.
