Of the many rallies at the state Capitol on Tuesday March 4, two contrasting ones stand out. The first involved hundreds of striking correction officers and their supporters standing in front of the capitol calling for better working conditions in the state’s prisons, starting with more staffing, less mandatory overtime, and the repeal of the HALT act which restricts the use of solitary confinement. While the Governor thought that a deal to end the illegal wildcat strike had been reached by March 7, including reviewing potential changes to the Halt Act, the union blocked it on the grounds that they had not been consulted. On Tuesday inside the Capitol, prison reform advocates called to enact several bills in response to the recent killings of two inmates by upstate correction officers – Robert Brooks and Messiah Nantwi. We hear from several state legislators – Assemblymembers Latrice Walker, Eddie Gibbs, and Anne Kelles, and Senator Julia Salazar. This was Mark Dunlea for the Hudson Mohawk Magazine.

Groups Call For Justice for Two Murdered Inmates

This week's guest is Rachel Barkow, a professor of law at New York University and the author of the book Justice Abandoned: How the Supreme Court Ignored the Constitution and Enabled Mass Incarceration, which was just released this month.

Barkow and Reason's Billy Binion talked about the importance of the presidential pardon power—which is a controversial topic these days, after former President Joe Biden used it to preemptively pardon Anthony Fauci and members of his own family, and President Donald Trump used it to pardon January 6 defendants, some of whom were convicted of assaulting law enforcement. They also discussed Barkow's view that certain Supreme Court precedents around criminal justice are alarming for anyone who cares about the Constitution and individual liberty. Finally, they chatted about what it was like for her to clerk for Supreme Court Justice Antonin Scalia—as a Democrat.

Why Due Process Matters

Nicole O’Byrne speaks with Wayne Sumner about his book, Prairie Justice: The Hanging of Mike Hack.

Prairie Justice explores the 1928 murder of George Edey in Saskatchewan and the swift conviction and execution of Mike Hack, a deaf and mentally disabled farmhand. Denied clemency, Hack was hanged in 1929 at the age of twenty-seven. Author Wayne Sumner traces the case from investigation to execution, drawing on personal family ties to the story. Through this gripping account, the book sheds light on broader issues in Canada's criminal justice system, including unfitness to stand trial, the insanity defence, ineffective legal representation, and the risk of wrongful convictions—ultimately exposing how justice can fail the poor and marginalized.

Innocent until proven guilty is known as a core value of the criminal justice system in this country, one that many of us often heard in Civics and American history class growing up. However, in reality, the presumption of innocence is only a trial right. The problem with that?  The problem with? Only 3% of cases actually go to trial;  almost everyone else takes a plea deal, which means that this core American value falls short of many people's reality in the U.S. criminal justice system. American Myths Part 2: Innocent Until Proven Guilty

On this episode of Everyday Injustice, host David Greenwald speaks with journalist and legal scholar Jessica Pishko about her acclaimed book The Highest Law in the Land, a deep dive into the growing political and institutional power of elected sheriffs in the United States. Pishko explains how sheriffs—often overlooked in criminal justice reform circles—have quietly become key enforcers of a right-wing populist agenda, rooted in a dangerous blend of electoral legitimacy, constitutional distortion, and unchecked local authority.

Pishko, whose book has become increasingly relevant amid the Trump administration's renewed embrace of “tough-on-crime” policies and anti-immigrant enforcement, shares how her reporting evolved over time. Initially approaching the topic as a straightforward study of criminal legal institutions, she soon realized she was documenting something far more urgent: the rise of a far-right movement within law enforcement, powered by sheriffs who see themselves as the ultimate arbiters of the Constitution—especially its Second Amendment—and defenders of an idealized, exclusionary vision of America.

The conversation touches on the alarming resurgence of programs like 287(g) task force agreements, the disproportionate policing and incarceration of poor, rural, and white communities, and the disturbing feedback loop between constitutional sheriffs and Trump-era authoritarianism. Greenwald and Pishko also discuss the moral and political implications of an elected law enforcement official wielding both symbolic and literal power, often with little oversight and immense local control.

Pishko’s thesis is both clear and controversial: the office of sheriff, as it currently exists, should be abolished. Drawing on a mix of legal history, investigative reporting, and on-the-ground interviews, she argues that reform has proven inadequate in the face of a deeply entrenched and ideologically driven system. As she puts it, every attempt at reform is met with a backlash "50 times the ask." This episode offers a chilling but essential look at how rural law enforcement has become a front line in America’s ongoing battle over democracy, race, and power.
