This podcast discusses the Court of Appeal (Civil Division) addresses the appeal of Refinitiv Limited and related companies against HMRC regarding the lawfulness of diverted profits tax (DPT) charging notices issued in 2021 for the 2018 accounting period. The central issue is whether these DPT notices, which charged over £167 million, were inconsistent with an Advance Pricing Agreement (APA) that had previously established a cost-plus transfer pricing methodology for the companies' services provided between 2008 and 2014. The court considered whether the 2018 chargeable period "relates to" the APA, as the DPT notices applied a different profit-split methodology to profits derived from those earlier services. The judgment ultimately dismissed the appeal, affirming the Upper Tribunal's decision that the APA's effect was limited to its specified duration, ending in 2014, and therefore did not constrain HMRC's use of DPT in 2018.
