In the episode of the IILAH Podcast, Professor Harro van Asselt (University of Cambridge) presents on the topic of phasing out fossil fuels under international law. This seminar was chaired by Professor Margaret Young and co-hosted with the Melbourne Centre for Law and the Environment. 

At the UN Climate Summit in 2023, the fight over a fossil fuel phase-out took centre stage, resulting in a decision calling on countries to ‘transition away’ from fossil fuels. Professor van Asselt first examined why there have been growing calls for a fossil fuel phase-out, and why international law should play a role in governing the transition away from fossil fuels. Next, he discussed the international regulation of phasing out fossil fuels, focusing on climate change law, human rights law, and investment law. Lastly, he explored options for reform, including through the international climate change regime as well as through a proposed fossil fuel treaty.

Harold Hongju Koh of Yale Law School discusses his new book, The National Security Constitution for the 21st Century, which examines the structural and systemic reasons for the dangerously increased strength of the executive branch of government in the U.S., and its implications for American use of force, foreign relations, and international law. We discuss not only the evolution and implications of these systemic failures, but also his recommendations for reform, and the role of lawyers and legal scholars in responding to the problem, and even revisit his own role in government in the context of these issues. Finally, we discuss how a second Trump administration makes the prospect of reform more difficult, and the outlook for international law more fraught - but ultimately we end on an optimistic and even inspiring note.

In this episode, Rishi Gulati is in conversation with Dr Patryk Labuda on the topic of Double Standards in International Law. Patryk Labuda  is presently Assistant professor of international law and international relations at the Central European University. Previously, he has been an assistant professor at the University of Amsterdam, and has held positions at the Geneva Academy of International Humanitarian Law and Human Rights, New York University School of Law, the Fletcher School of Law and Diplomacy, University of Zurich, the Polish Academy of Sciences, and Free University of Berlin. The discussion focuses on what the phrase double standards in international law actually means, how double standards are manifested in contemporary practice, how double standards impact the credibility of international law, and what can be done about it.

Carmen Corbin dreamt of serving with the United Nations from an early age. Now head of transnational organized crime, illicit trafficking and terrorism prevention programs at the United Nations Office on Drugs and Crime (UNODC) in East Africa, she is dedicated to protecting children from shocking online exploitation.

The UNODC supports law enforcement efforts in tackling all transnational organized crime and counter terrorism, including cybercrime. In this episode, Carmen Corbin reflects on the challenges of overseeing a wide portfolio, on the psychological strain of prosecuting the worst kinds of cybercrimes and shares her advice for a successful international career.
