In this episode, Julian A. Hettihewa presents on ‘The Principle of Distinction in International Humanitarian Law’. According to the principle of distinction, the parties to a conflict shall at all times distinguish between civilians and combatants. Described as one of the cardinal principles of international humanitarian law, the principle thus requires that civilians are never made objects of attacks. Underneath these seemingly objective and neutral concepts are real human beings. Available data indicates that the vast majority of victims of direct conflict are young men. Against this background, this talk seeks to examine the relevance of the principle of distinction for young people. It suggests that youth as a social category is constructed by international law as dream/nightmare and that this may inform decisions on targeting. The talk concludes with an invitation to use existing critical approaches to explore further areas of international law with a sensibility for young people and youth. The episode is an edited recording of a seminar presented on 5 December 2023, chaired by Dr Carrie McDougall and hosted by IILAH. 

Julian A. Hettihewa is a research assistant and PhD candidate at the Institute for Public International Law, University of Bonn. His research focusses on the relationship between youth and international law and forms part of what may be called Young Approaches to International Law.

In this episode, Rishi Gulati is in conversation with Dr. Nikos Skoutaris on accommodating secession within the EU Constitutional Order. Dr. Skoutaris is an Associate Professor in European Union Law at the University of East Anglia, holding a PhD from the European University Institute. He has an extensive background, including roles as a Post-doctoral Fellow at the University of Tilburg, an Assistant Professor at Maastricht University, and a Senior Research Fellow at the London School of Economics. The conversation explores secession and its ties to the right to self-determination, the conditions under which secession might be allowed in international law, the domestic law prerequisites for secession, and, importantly, the scenarios in which the EU constitutional order might permit a seceding state's admission into the EU. Alice was joined in conversation with Professor Gerry Simpson, author of 'The Sentimental Life of International Law' and Professor of Public International Law at LSE Law School. They discussed the whys, hows and wheretos of seeing environmental images in international legal process.

Following on from the discussions that took place during the recent IHL Talk on ‘The Weaponizing of Water in Contemporary Armed Conflicts’, Dr Eugenie Duss, researcher at the Geneva Academy speaks to Mark Zeitoun, Director General, Geneva Water Hub and Professor of Water Diplomacy, Geneva Graduate Institute, and Abby Zeith, Legal Adviser, Arms and Conduct of Hostilities Unit, Legal Division, International Committee of the Red Cross.

Subjects covered in the episode include role of expert engineers in decision processes related to the targeting of water during hostilities, the historical and contemporary use of water as a weapon, and the need for more research around these topics. The guests were also able to frame the issues in the context of their current roles and give some examples of positive developments in the legal work that is going into preventing the use of water as a weapon.

The latest episode of our 'In and Around War(s)' podcast follows on from the IHL Talk 'The Prosecution of Ecocide and Other Environmental Crimes: State of the Law and Way(s) Forward' which took place in April. In the episode our Research Fellow, Eugénie Duss, speaks to Jelena Aparac, from UN SWTP, and Stavros-Evdokimos Pantazopoulos, from of the Erik Castrén Institute at the University of Helsinki. 

The discussion covers the recent and ongoing proceedings addressing climate change outside the criminal framework, focusing in particular on the case of Verein Klimaseniorinnen Schweiz and others v. Switzerland. It also covers the request for an advisory opinion on climate change before the International Tribunal for the Law of the Sea, and also the worrying tendency of the investor-state dispute settlement system to award large compensations to investors against states that adopt stricter environmental and climate change measures.

Queer Judgments is intended to be a teaching, research, and advocacy resource for anyone interested in critical perspectives on jurisprudence, queerness, and social justice.

'Queer Encounters with International Law' and 'Queer Engagements with International Law' are sibling edited books, which apply insights from queer theory to a range of new issues and topics in international law. Queer Encounters explores new issues relating to gender, sexuality and LGBTIQ communities in international law, such as recent contestation over the definition of ‘gender’ in international criminal and human rights law and the possibility of building an international queer abolitionist movement. Queer Engagements moves beyond queer theory’s site of origin by applying queer theory to a range of new topics international law not directly related to gender and sexuality, including international environmental law, international space law, international heritage law and travaux préparatoires.

Queer Connections: A Triple Book Launch

The Institute for International Law and the Humanities was pleased to celebrate the publication of Associate Professor Anna Arstein-Kerslake's book, 'The Right to Legal Personhood of Marginalised Groups'. Anna was joined in conversation with Dr Erin O'Donnell and Associate Professor Olivia Barr. Professor Margaret Young chaired this event.

The right to legal personhood has been enshrined in human rights law since its inception with the Universal Declaration of Human Rights in 1948. However, the right has been largely overlooked. This book explores the marginalisation occurring as a result of barriers to the right to legal personhood and how this can be rectified. It analyses the right in relation to disability, gender, indigenous people, racial minorities, migrant groups, and stateless people. It presents a legal argument for the protection of the right and a normative analysis of the importance of the right in achieving equality in socio-legal systems
