Residential Land Development: From Lot to Community

This podcast presents a determination from the Tax Appeals Commission regarding an appeal against amended income tax assessments issued by the Revenue Commissioners for the years 2008-2015. The core issue revolves around whether the Appellant was engaged in the trade of land development, entitling him to claim significant trading losses. The Appellant maintained he bought land in 2005 with the intention of developing it for resale, while the Respondent argued he never truly commenced trade, pointing to factors like the agricultural zoning of the land, the absence of planning permission, and a lack of formal development financing. The Commissioner ultimately upheld the Revenue Commissioners' decision, finding that the Appellant did not genuinely intend to trade in land development, nor did such a trade ever commence, and also found that the amended assessments were valid despite being outside the typical four-year period due to the Appellant's tax returns not containing a "true and full disclosure."
