Living in Salford, we're surrounded by cranes and new blocks of flats being built. That's not so bad, as most of the new tower blocks of apartements are being constructed on 'brownfield' sites, like empty plots and old industrial units, and so on. Nobody expects - well, nobody expected - that property developers would be so bold as to create their own brownfield site - by demolishing a whole retail park of active shops! They say, oh, they're a bit rundown. Speak for yourself, chum. For the residents of Ordsall, they are an essential part of their day-to-day lives, but then, the developers don't know that, since their company is based in the Channel Islands.
Maybe it wouldn't be so bad if these 'developers' paid taxes, but they don't. And, if they honoured their obligations to contribute Section 106 money to develop local amenties, like doctors and schools, but they don't. They've offered a million pounds to 'local parks', but now, it turns out, the local park they were thinking of is the winding walkway and patches of grass between their new tower blocks. So they will be holding on to the Section 106 cash, after all, and spending it for their benefit, not the residents.
Dishonest? Some might say so.

Property Development Finance in Australia with Commercial Mortgage Broker

The judgment emphasizes that added value determines tax liability, consistent with prior court rulings, irrespective of national implementation specifics.

Case C-239 22 Belgian State and Promo 54 (9 March 2023)

This podcast concerns the interpretation of the EU's VAT Directive. The case is relating to an association without legal personality that constructed and sold apartments, specifically addressing who is considered a taxable person and their VAT deduction rights. The central issue revolves around whether individuals party to an unregistered association contract can be deemed taxable persons alongside the entity liable for output tax, and if a taxable person can deduct input VAT when invoices are not in their name. The Court clarified that unregistered members of an association are not automatically considered taxable persons and detailed the conditions for VAT deduction, requiring objective evidence that goods and services were indeed used for the taxable person's output transactions. Ultimately, the Court ruled on the interpretation of key articles within the VAT Directive related to taxable persons, VAT deduction, and the principles of proportionality and fiscal neutrality in the context of such associations.

Case C‑519 21 DGRFP Cluj (16 February 2023)

This podcast concerns the interpretation of Article 392 of the VAT Directive relating to the margin scheme for VAT on resales of buildings and building land. The case specifically addresses situations where VAT was not deductible on the initial purchase of the property. The Court determined that the margin scheme can apply when the initial purchase price incorporated VAT that the seller paid as input VAT, but the scheme generally does not apply if no VAT was paid on the initial purchase. Furthermore, the court clarifies that the margin scheme does not apply when land purchased as undeveloped becomes building land between purchase and resale, but it can apply when building land is altered (e.g., divided into lots) between purchase and resale.

Case C-299 20 Icade Promotion (30 September 2021)

This podcast concerns a request for a preliminary ruling from a Romanian court to the Court of Justice of the European Union. The case involves two individuals, Radu Florin Salomie and Nicolae Vasile Oltean, and the Romanian tax authorities. The core of the dispute concerns whether an unregistered partnership of natural persons, formed for building purposes, can be considered a taxable person for VAT. The questions presented also address whether the tax authorities' actions of reclassifying transactions after a significant period, impacting the right to deduct VAT paid, and the application of special exemption schemes, are consistent with the principles of legal certainty, legitimate expectations, fiscal neutrality, and various articles of the VAT Directive.
