Trump 2.0 is causing mass anxiety throughout “Indian Country” and across Turtle Island so far in 2025. As of mid-June 2025, the Trump Administration’s proposed Fiscal 2026 federal budget calls for nearly $1 billion in cuts to the United States Bureau of Indian Affairs (BIA) and other federal Native American programs. In addition, President Trump signed “Birthright Citizenship” Executive Order 14160 on January 20th, 2025, where the Trump Administration believes it could denaturalize Native American U.S. citizenship, especially if the U.S. Supreme Court in Trump v. CASA, Inc. agrees with the Trump Administration.

But Native America nations have an extra-constitutional relationship with the United States government, and this extra-constitutional relationship is the result of more than 380 signed and ratified treaties between Native American nations and the U.S. government – an approximate similar number of treaties were signed but never ratified. The U.S. government, however, must legally and adhere to its “Trust” responsibilities its treaty obligations. 

Enduring questions are guest addresses: Do the Trump Administration’s proposed budget cuts along with the DOGE cuts to federal programs violate the Treaties between Native American nations and the Trust Doctrine? In addition, does President Donald Trump’s Birthright Citizenship executive order place Native Americans in real threat of losing their U.S. citizenship contrary to the Indian Citizenship Act of 1924? Lastly, does the combined actions of the Trump Administration plausibly suggest the possibility of new “Terminations” reminiscent of the 1950s?

Today on American Indian Airwaves, our guest for the hour provides an in-depth description and analysis on the Trump 2.0 Administrations actions within the context of the understanding the legalities and constitutionality of the treaties between the Native American nations and the U.S. federal government. Today’s interview was conducted prior to the four recent SCOTUS and lower court decisions on the Birthright Citizenship executive order.

David E. Wilkins, a citizen of the Lumbee Nation, is a political scientist specializing in federal Indian policy and law. He is the E. Claiborne Robins Distinguished Professor in Leadership Studies in the University of Richmond’s Jepson School of Leadership Studies and professor emeritus of the University of Minnesota. He studies Indigenous politics, governance, and legal systems, with a particular focus on Native American sovereignty, self-determination, and diplomacy.

In this episode of "The Trial Lawyer's Handbook" podcast series, litigation attorney Dan Small explains the exclusionary rule, which states that evidence obtained by illegal methods must be excluded at trial. In the Cammarata drugs-and-murder Racketeering Influenced and Corrupt Organizations Act (RICO) case, a voluntary eight-page confession was initially suppressed under the exclusionary rule because the Texas Rangers did not include the arrested individual's last name on the warrant. Mr. Small appealed the decision, and the U.S. Court of Appeals for the Fifth Circuit ruled in his favor, making the confession admissible at trial. The ruling helped establish the "good-faith exception" to the exclusionary rule, which was soon officially adopted by the U.S. Supreme Court.

The guest host for today's show is Brad Bannon. Then, Brad is joined by Ana Valdez, President & CEO of the Latino Donor Collaborative (LDC), which produces the annual U.S. Latino GDP Report. 

The two examine the contributions made by Hispanic Americans, as well as their population and economic trends, in honor of Hispanic Heritage Month.

Brad and Ana also talk about the repercussions from the Supreme Court decision that allows ICE to resume arrests in Los Angeles based on appearance, language, or type of work.
Drawing on the LDC's data showing Latinos as one of America's fastest-growing economic engines, Ana also released a statement emphasizing that the Court's decision carries consequences far beyond immigration enforcement:
"This is not law enforcement; it is racial profiling.
That is not how the Fourth Amendment is supposed to work. The Constitution requires specific facts, not a checklist of skin color, language, and job site.

It also ignores economic reality. Latinos are not on the margins of this country; we are a major growth driver. Our GDP reached $4 trillion in 2023, making us the fifth-largest economy in the world if measured independently. Latino incomes and purchasing power are growing about twice as fast as the rest of the country, and Latino consumer spending topped $2.5 trillion last year. Targeting people who look or sound Latino undercuts the workforce and the businesses that keep the U.S. economy strong for everyone. Profiling this workforce is economic self-harm.

And it ignores the community reality. Most Latinos are fully part of the American fabric. Ninety-four percent of Latinos under 18 are U.S.-born, and nine out of ten Latinos overall are citizens or lawful residents. Treating Spanish speakers or brown people as presumptive suspects means punishing citizens on their way to work and parents on school runs, not just the undocumented.

Enforcement of immigration law cannot come at the cost of civil liberties and human dignity.
America's economic future depends on treating Latinos as full and equal participants in our society, not targets of suspicion."
