This podcast discusses the First-Tier Tribunal Tax Chamber addresses an appeal by Trevor John Masters against HMRC regarding UK income tax on pension withdrawals. The central issue revolves around the UK-Portugal Double Tax Convention (DTC), specifically whether Masters' pension withdrawals, received while he was a tax resident in Portugal, should be taxed in the UK or Portugal. The tribunal considers two main points: first, if the Self-Invested Personal Pension (SIPP) withdrawals were "paid in consideration of past employment" under Article 17 of the DTC, which would limit taxation solely to Portugal; and second, if they fall under Article 20 of the DTC, which concerns "income not expressly mentioned" and requires the income to be "subject to tax" in Portugal to prevent UK taxation. Ultimately, the Tribunal found in favor of Mr. Masters on the first issue, concluding that the withdrawals were indeed in consideration of past employment, thereby allocating the taxing rights to Portugal and resolving the appeal without needing to definitively rule on the second point.
