This podcast discusses a United Kingdom Supreme Court judgment concerning a dispute between Mr. Derry and HMRC over the correct treatment of share loss relief claimed against income from a prior tax year. The appeal addressed two main issues: whether the claim, made under the Income Tax Act 2007 (ITA), was correctly applied to the previous year, or if it was overridden by procedural rules in the Taxes Management Act 1970 (TMA). The majority judgment ruled in favor of Mr. Derry on the first issue, finding that the ITA established a clear and self-contained code for calculating his tax liability that was not displaced by the TMA's management provisions. This interpretation stressed the legislative intent of the Tax Law Rewrite project to provide clarity and coherence for taxpayers. Although the first finding made the procedural second issue technically moot, the court included obiter dicta regarding the handling of inquiries when an erroneous claim is included within an online self-assessment tax return.
