NIMBY (feat. LURID) (ForeignerBoi × Sarg)

On this episode of Free Range, host Mike Livermore is joined by Lee Fennell, a law professor at the University of Chicago and author of Slices and Lumps: Division and Aggregation in Law and Life,.
The conversation begins with a discussion of the role of aggregation in law. Fennell explains that in many other contexts, resources only provide value when they are combined into usable chunks. Property law can be understood as balancing two competing concerns – facilitating the aggregation of recourses to create value (on the one hand), and avoid too much aggregation, which can create opportunities for free-riding (0:36-18:13).
Fennell explains how property law helps individuals and groups create stream of benefits. Property law is distinctive, in part, because it involves the concept of ownership. But property's traditional model of ownership doesn't always fit modern needs to solve new collective action problems. Ideally, property owners have some power over their property – and confidence that their rights will remain stable, while also not being able to impede how things are put together for the greater good. Stability is important for property owners, but the world is dynamic. Culturally, there's a conflict between the idea that property ownership involves absolute control and the reality that it's constrained by regulations and external factors. A major challenge for the future is to redefined concept of property in a way that's more adaptable but still aligns with people's expectations of stability. One solution could involve allowing ownership interests over certain benefits (like housing) but not fixed to a specific physical footprint (like a particular house), providing flexibility while maintaining stability (18:14- 37:35).
Fennell is interested in how private and entrepreneurial efforts can work alongside existing property concepts to find ways to address challenges. This includes utilizing law to facilitate voluntary transactions and dynamic property management. However, Livermore points out that government coercion is inherent to property law. Fennell describes the challenge as transitioning from traditional property expectations to more flexible models that encourage voluntary interactions and entrepreneurial solutions, adapting property arrangements to address today's urban and environmental challenges.  
In reimagining property systems, two major changes could be considered: first, making property ownership less permanent and allowing for adjustments; second, moving away from fixed geographic locations and making property rights more dynamic. This could involve creating options for property ownership that can be called back or reconfigured under certain conditions and enabling more flexibility and collaboration among owners for potential redevelopment. Another approach might involve concentrating property under a single owner who can then rearrange holdings, but this approach comes with its own challenges of concentration and scale. These ideas aim to introduce more adaptability and responsiveness to property systems while still maintaining individual ownership. Lastly, addressing inequality through property involves considering how services are created and distributed, as political decisions and public goods shape property's value and impact; illuminating these dynamics can help reveal alternative ways to configure property for a more equitable outcome (37:36- 1:02:27).

In this week’s episode, host Daniel Raimi talks with Holly Caggiano, an assistant professor at the University of British Columbia, and Sara Constantino, an assistant professor at Stanford University, about the preferences of local residents and elected officials for large-scale energy projects in Pennsylvania. Caggiano and Constantino discuss factors that influence public support for renewable energy projects and the occasional misalignment between the perceived preferences and actual preferences of constituents from the perspective of their local elected officials.

Local Attitudes Toward Energy Projects, with Holly Caggiano and Sara Constantino

If NIMBY is the classist rejection of affordable housing ("Not in my back yard”), then YIMBY is sold as the progressive counter to it: “Yes, in my back yard; because I believe affordable housing should be widely available, even in my own neighborhood.” But of course, housing development has nothing to do with the needs of the poor or the working class. It has nothing to do with the public purpose. 

Steve’s guest, political economist David Fields, explains: 

“YIMBY is yes to housing in my backyard, but housing for developers to extract profit from land value.  So build as much as possible within a given area and, in the end, extract as much as possible through rent extraction and land value appreciation. It's not, in my view, yes to actual affordable housing in my backyard to house working class folks. No, it's yes to luxury skyscrapers, luxury this, luxury that. Build as cheaply as possible for vested interests to maximize gain.” 

YIMBY’s want us to believe that sheer quantity will bring prices down, because that’s how the market works.  Those who object are accused of NIMBYism. In addition,  

“They're economically illiterate, they're economically stupid, they don't know, they don't pay attention, and they're not letting the magic do its magic. Which, anybody who knows a modicum of economics and knows that supply and demand is institutionally configurated - not natural  - should be flabbergasted and say, how did this get to be so popular, so celebrated?  Well, there are vested interests involved.” 

The episode explores the misleading narratives of YIMBYism and compares the market-driven approach to housing to trickle-down economics, emphasizing the constructed scarcity and profit motives behind urban planning. David points out the misuse of economic models like the Marshallian Cross, highlighting flaws in the market logic often used to justify YIMBY policies.  

David and Steve talk about the broader neoliberal agenda of privatization and deregulation, and its stranglehold on government policies. Awareness and organization are needed to combat systemic class inequality in housing and beyond. 

David Fields is from a critical realist and genetic structuralist ontology and epistemology. His work centers on the intricacies concerning the interactions of foreign exchanges and capital flows, with economic growth, fiscal and monetary policy and distribution, whereby critical attention is paid to the notion of endogenous money. He also delves into the political economy of regional development to study patterns with respect to the nature of housing, social stratification, and community planning.

What Does NIMBYism Cost Society?, with Stephen Jarvis

In this week’s episode, host Kristin Hayes talks with Daniel Poneman, a senior fellow at the Council on Foreign Relations and former Deputy Secretary of the US Department of Energy, about the role of nuclear energy in meeting increasing demands for electricity. As the use of artificial intelligence grows, so does demand for electricity, raising questions about which energy sources can provide reliable, clean, consistent power. Poneman discusses whether nuclear energy is a viable option, how the safety and performance of nuclear technology have evolved, and why some retired nuclear power plants are being revived—including the Three Mile Island nuclear plant in Pennsylvania, where a reactor meltdown caused by equipment malfunctions occurred 46 years ago as of last Friday. Poneman also describes what challenges the nuclear energy industry is facing, barriers to wider adoption of nuclear energy, and how public perception of nuclear energy has shifted over time.
