This podcast concerns the judgment of the First-Tier Tribunal (Tax Chamber) in the case of Bilfinger Salamis UK Limited (Appellant) versus HMRC (Respondents). The case concerns a tax dispute regarding secondary Class 1 National Insurance contributions, stemming from an offshore employment model implemented by the Appellant. Specifically, the Tribunal determines if the Appellant is liable for these contributions under a "host employer" provision of the Social Security (Categorization of Earners) Regulations 1978. The Tribunal ultimately concludes that the Appellant is indeed liable for the contributions, as the evidence indicates that the personal services of the employees were "made available" and "rendered" to the Appellant for the purposes of its business, fulfilling the criteria outlined in the host employer provision.
