Les ADIL de la Métropole du Grand Paris, de Lyon et d’Aix-Marseille-Provence se mobilisent durant 6 semaines pour vous proposer une chronique spéciale sur la « prévention des expulsions locatives.
Etape 2 : L’assignation
L’assignation en justice est l’acte introductif d’instance qui marque la première démarche judiciaire du propriétaire-bailleur.
Cette convocation devant le tribunal invite le locataire à se présenter à une audience qui aura lieu dans un délai de deux mois minimums.
La procédure devant le tribunal étant orale et contradictoire, la présence du locataire à l’audience est donc essentielle pour que sa situation soit représentée. La décision d’accorder des délais de paiement est largement conditionnée par la présence du locataire à l’audience.
Le locataire, tout comme le bailleur, peuvent se défendre eux-mêmes ou se faire représenter (avocat, conjoint, concubin etc…).
Les locataires confrontés à cette situation peuvent s’orienter vers les ADIL afin d’obtenir une information sur les conséquences d’une assignation et plus généralement sur le déroulement de l’audience, les délais que peut accorder le juge mais aussi sur la validité juridique de la dette ou encore sur les modalités de l’aide juridictionnelle.

Les étapes de la procédure d'expulsion locative, étape 2 : l'assignation

Les ADIL de la Métropole du Grand Paris, de Lyon et d’Aix-Marseille-Provence se mobilisent durant 6 semaines pour vous proposer une chronique spéciale sur la « prévention des expulsions locatives.
Etape 3 : Le jugement
Le jugement prononcé par le tribunal judiciaire est l’étape la plus importante, la pierre angulaire de la procédure d’expulsion.
Sans ce titre exécutoire, il n’est pas possible pour un bailleur d’obtenir l’expulsion de son locataire.
Dans le cadre d’une procédure visant la résiliation du bail et à l’expulsion, le juge du tribunal judiciaire peut prendre plusieurs décisions comme accorder ou suspendre les effets de la clause résolutoire, accorder des délais de paiement, accorder l’expulsion du locataire ou encore, accorder des délais pour quitter les lieux.
Il est donc essentiel de bien comprendre le contenu de ce jugement.
Les locataires confrontés à cette situation peuvent s’orienter vers les ADIL afin d’obtenir une information sur le contenu et les conséquences d’un jugement d’expulsion locative.

Rick Caddick joined Lindsey Harren. He is the Deputy Fire Chief of Quinte West and the Mutual Aid Coordinator with Hastings and Prince Edward Counties.

Caddick was one of seven people who received honorary diplomas from Loyalist College during Convocation.

City College kicked off  the new 24-25 school year with its Fall 2024 Convocation. Administrators and speakers presented on upcoming project like the new bond measure on the ballot, the new cyber defence bachelor's program, and the campus' recognition of AI as an integral part of the learning environment.
